Terms and Conditions

Thank you for choosing to book your holiday with Gannet d.o.o. Please check this information carefully and do not hesitate to contact Gannet d.o.o. if you have any queries. Please check that the names in your passport match exactly the client names in your booking confirmation. If this is not the case please contact Gannet d.o.o. within 48 hours of receipt of the invoice.

 

Payment Schedule

 

25% deposit is required to confirm your reservation.
Full prepayment will be required in 30 days prior to the embarkation date.

 

Cancellation Terms

 

25% will be charged if cancelled after the reservation is secured with a deposit payment.
100% will be charged if cancelled 29 days prior to the embarkation date or less.

 

Booking Conditions

 

It is important that you read the following booking conditions carefully as they set out our respective rights and obligations. By paying you completely accepts these Booking Conditions. In these booking conditions, Gannet means travel agency Gannet d.o.o. and you means all persons named on the booking. Red Sea Kiting and Safari Maris are trading names which are related to Gannet d.o.o. Gannet d.o.o. is tour operator company, registered in the Republic of Slovenia since 2015. Our license is issued by Chamber of Commerce and Industry of Slovenia as official license for travel agency and tour operating.

A contract between us will only come into effect when we send you email booking confirmation document after we receive first deposit or full payment in accordance with Payment Schedule as shown in your confirmation. When the contract comes into effect, we become responsible to provide you with the holiday you have booked, and you become responsible to pay for it, in each case subject to these terms and conditions.

In parties of two or more people, the person who actually makes the booking is the person whom we make the contract with and that person accepts responsibility for making all payments to us for all members of the party. Conversely, we will send all documents and other information to that person alone, who will be responsible for ensuring that all other members of the party are kept fully informed.

 

Description of services.

 

The liveaboard facilities and travel services offered to you by Gannet via email or in any other way, specified in the invoice (or proforma invoice) are also described and illustrated online at our websites. Gannet shall not be responsible for any verbal or written information obtained from a third party differing from the description of facilities and services in our offers and on our websites.

At the time of booking, we also require the following information from all party members:
– Title & Full Name (as it appears on your passport)
– Passport Number & Nationality
– Date of Birth
– Insurance Policy Number, Provider and Contact Telephone No.
– Emergency Contact Details

Please ensure you have at least 6 months validity left on your passport on the start of your trip.

 

If you wish to change or cancel your booking, you may have to pay an amendment or cancellation charge and additional costs (see cancellation terms) which may be as much as the whole of the original price of your arrangements.

Please note that travel arrangements may be subject to change. Change of accommodation to another of the same standard or higher within the same resort area or liveaboard is deemed to be a minor change. Minor change is not subject to refund.

If we make a major change to your holiday, we will inform you as soon as reasonably possible if there is time before your departure. You will have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements from us if available or cancelling your booked holiday and receiving a full refund of all monies paid except where the major change arises due to reasons of force majeure. Major changes may include change of your accommodation to that of a lower rating/classification or change of your holiday to a different area or dates.

Refund does not apply to circumstances beyond our control (force majeure). We or our partners can cancel your holiday in the following circumstances: war, threat of war, riots, civil strife or terrorist activity, industrial disputes, pandemics or massive infection outbreak, natural or nuclear disasters, fire, technical problems with transport, airport closures, bad weather conditions and similar events beyond our control.

 

Activities and Weather Conditions

 

Unfortunately weather patterns are hard to predict. In light of this you will have to accept that on some occasions at the discretion of the cruise manager it may not be suitable or safe to conduct activities at your chosen location. On liveaboard boats an alternative itinerary may be necessary if weather conditions prove too difficult for kiting, diving or other planned activities. We cannot be held responsible or liable for weather patterns and the resulting loss of kiting or diving days, courses or activities. You may of course make a claim under the terms and conditions of your insurance policy.

 

Corona Virus Terms.

 

Unfortunately, since the beginning of pandemics travel restrictions and state of your health often affect holiday plans. We do our best to make your holiday happen in these circumstances. You will receive your paid travel sum back if your trip cannot take place due to the New Corona restrictions. Under such New Corona restrictions we understand cancelled flights or closed borders. We offer rescheduling and don’t offer refund in case you were tested positive right before the trip. Please make sure your insurance covers such risks.

 

Insurance.

 

It is Your responsibility to ensure that you have adequate insurance cover for your arrangements and activities and we can accept no responsibility if you fail to take out appropriate insurance in relation to these holiday arrangements. You must provide us with details of your insurance cover (insurers and policy numbers) in case we or our partners need to contact them on your behalf.

 

Applicable law and jurisdiction.

 

Gannet services are governed exclusively by the substantive laws of the Republic of Slovenia to the exclusion of conflict of law legislation as well as international law. The courts of Ljubljana, Slovenia, shall have exclusive jurisdiction for all disputes. To the extent permitted by law, the courts of Ljubljana shall be competent.
